These don't usually happen very often, just want to get some crap out.
I'm going to be a dad in February, except that it's with my ex and we're not getting married. Through a series of circumstances I've come to realize that I can't trust her at all and will never know if what she's telling me is true. In trying to figure out the best thing for our daughter we've settled on adoption... reluctantly. There just really isn't an option that's fair to either parent and would guarentee the best opportunity for the child... except to be raised by a couple who is happily married and I don't want to risk divorce. Well, my ex (who my friends are sure is a complete psycho by now) blames me for this decision saying that I never really wanted a child anyways. Anyone who knows me and has talked with me about this situation knows differently, as should my ex except that she only hears and understands what she wants to.
Then, within 24 hours of finding out that my daughter is going up for adoption and my ex is blaming me, I get called into a meeting at work along with my immediate supervisor and our departments manager. Short meeting, the basics of which are: I'm not going to be interviewed for the promotion I applied for, nor are they going to put me in a sales position at all because I'm hearing impaired.
Two days later (today) I see the store manager and decide to talk to him about my meeting with my manager. The store manager backs my manager with the following: "I've seen you with customers and know that you're good and the customers like you, but what if someone where standing behind you or to the side of you and you didn't hear them trying to talk to you..." So, I get to call HR and have a conversation with them to see if they support that decision too... which I highly doubt they will. |

That discrimination.
American with Disabilities Act wrote: |
Title I of the Americans with Disabilities Act of 1990 prohibits private employers, state and local governments, employment agencies and labor unions from discriminating against qualified individuals with disabilities in job application procedures, hiring, firing, advancement, compensation, job training, and other terms, conditions, and privileges of employment. The ADA covers employers with 15 or more employees, including state and local governments. It also applies to employment agencies and to labor organizations. The ADA's nondiscrimination standards also apply to federal sector employees under section 501 of the Rehabilitation Act, as amended, and its implementing rules.
An individual with a disability is a person who:
* Has a physical or mental impairment that substantially limits one or more major life activities;
* Has a record of such an impairment; or
* Is regarded as having such an impairment.
A qualified employee or applicant with a disability is an individual who, with or without reasonable accommodation, can perform the essential functions of the job in question. Reasonable accommodation may include, but is not limited to:
* Making existing facilities used by employees readily accessible to and usable by persons with disabilities.
* Job restructuring, modifying work schedules, reassignment to a vacant position;
* Acquiring or modifying equipment or devices, adjusting or modifying examinations, training materials, or policies, and providing qualified readers or interpreters.
An employer is required to make a reasonable accommodation to the known disability of a qualified applicant or employee if it would not impose an "undue hardship" on the operation of the employer's business. Undue hardship is defined as an action requiring significant difficulty or expense when considered in light of factors such as an employer's size, financial resources, and the nature and structure of its operation.
An employer is not required to lower quality or production standards to make an accommodation; nor is an employer obligated to provide personal use items such as glasses or hearing aids.

Tell your Human Resources contact to very closly obseve their companies adherance to the Equal Oppertunity Employment Act and subsequent American with Disabilities Act regarding this matter and that if she does not then you will. And do. Letting a company balls you around like this isnt fair and goes against company and government policy. Besides, if they arent going to consider you for promotion then you've got nothing to lose. Be sure to use your supervisor's words like you described them here. You blantantly received the indication that you were qualified for advancement, but not allowed for interveiw because of your companies non compliance with the EEOC. |

That really sucks about your family situation. I couldn't imagine what you're going through.
On a side note, your employers are full of donkey poo. Unless I'm misunderstanding the Americans with Disabilities Act (ADA), you cannot be treated unequal from other employees because of a disability like that. If they're an EOE, then they are obligated to comply with ADA. At least, that's my take on it. If you are physically able to perform the job, without the employer having to change things for you, then you are as able as any other employee. And if you're in customer service, why would you be dealing with a customer behind you?!? Come on, at least make something up that's believable. So, yeah, I suggest doing some research on ADA and calling them on it. It's crap they're treating you this way and hopefully you can set them straight. |

Yeah, fully aware of laws and have support from my parents and some of my co-workers. Something will happen in my favor because this company doesn't want this kind of reputation, especially during a time when they are having to compete so fiercly with their competators... I'm butchering my spelling, but I'm on my brothers laptop and the keys hate me. |
